1. Introduction & Acceptance
Welcome to StreamVault (“we,” “our,” or “us”). These Terms of Service (“Terms”) govern your access to and use of our managed VOD archiving service (the “Service”).
By creating an account, subscribing to a plan, or otherwise using StreamVault, you agree to be bound by these Terms. If you do not agree to these Terms, you may not use the Service.
We may update these Terms from time to time. We will notify you of material changes at least 30 days before they take effect. Your continued use of the Service after changes become effective constitutes acceptance of the revised Terms.
2. Eligibility
To use StreamVault, you must:
- Be at least 16 years of age. If you are under 18, you represent that you have your parent or guardian’s consent to use the Service.
- Have the legal capacity to enter into a binding agreement.
- Not be prohibited from using the Service under applicable law.
If you are using the Service on behalf of an organization, you represent that you have authority to bind that organization to these Terms.
3. Service Description
StreamVault provides automatic archiving of Twitch live streams (“VODs”) and associated chat logs. The Service:
- Captures live streams directly from Twitch in real-time as you broadcast.
- Preserves original audio at source quality as broadcast.
- Archives chat logs synchronized with video content.
- Stores content on enterprise-grade cloud infrastructure.
- Provides download access to your archived content via a web dashboard.
Storage is measured in hours of archived content. Each subscription tier includes a monthly storage quota.
4. Account Terms
A. Registration
You must provide accurate, complete, and current information when creating an account. You are responsible for maintaining the accuracy of this information.
B. Account Security
You are responsible for safeguarding your account credentials and for all activity that occurs under your account. Notify us immediately at blake@streamvault.gg if you suspect unauthorized access.
C. One Channel Per Account
Each StreamVault account is linked to a single Twitch channel that you own or have explicit authorization to archive. To archive multiple channels, you must maintain separate subscriptions for each channel you are authorized to archive.
D. Team Access
Account owners may invite team members with limited permissions. Team members are subject to these Terms, and account owners are responsible for their team members’ compliance.
5. Subscription & Billing
A. Subscription Tiers
We offer the following subscription tiers:

B. Billing Cycles
Subscriptions are billed either monthly or annually, depending on your selection at checkout. Annual subscriptions receive a discount equivalent to two free months.
C. Auto-Renewal
Subscriptions automatically renew at the end of each billing period unless you cancel before the renewal date. You authorize us to charge your payment method on file for renewal fees.
D. 14-Day Money-Back Guarantee
If you are not satisfied with the Service, you may request a full refund within 14 days of your initial subscription purchase. To request a refund, contact us at blake@streamvault.gg. This guarantee applies to first-time purchases only and does not apply to subscription renewals.
E. Price Changes
We may change subscription prices with at least 30 days’ notice. Price changes will take effect at your next billing cycle after the notice period.
6. Automatic Quota Enforcement
A. Storage Limits
Your subscription tier includes a specific storage quota measured in hours of archived content. VODs consume quota while stored.
B. Grace Period
If you exceed your tier’s storage limit, you have a 12-hour grace period before automatic enforcement begins.
C. Automatic Deletion
After the grace period, the system automatically deletes the oldest VODs (by stream date) until your usage returns to within your tier limit. This process is irreversible.
D. Notifications
We will attempt to notify you via email before automatic deletion occurs. You may disable these notifications in your account settings, but this does not prevent automatic deletion.
E. Your Responsibility
It is your responsibility to monitor your storage usage and download or delete content as needed to stay within your quota.
7. Cancellation & Data Retention
A. Cancellation
You may cancel your subscription at any time through your account dashboard. Cancellation takes effect at the end of your current billing period.
B. Post-Cancellation Grace Period
After cancellation, you have 7 days to download your archived content. During this period, you retain read-only access to your files.
C. Permanent Deletion
After the 7-day grace period, all your VODs, chat logs, thumbnails, and associated metadata are permanently deleted from our servers and storage systems.
D. Immediate Deletion
You may request immediate deletion of your account and all associated data at any time by contacting us at blake@streamvault.gg.
8. Acceptable Use
You agree to use the Service only for lawful purposes and in accordance with these Terms. Specifically, you agree not to:
A. Content Restrictions
- Archive content from any Twitch channel that you do not own or have explicit written authorization to archive.
- Store content that is illegal, defamatory, obscene, or infringes on third-party intellectual property rights, including copyrights and trademarks.
- Use the Service to archive content containing material you do not have the right to reproduce or store, including but not limited to copyrighted music, videos, or other protected works.
- Archive content that violates Twitch’s Terms of Service or Community Guidelines.
- Use the Service for any purpose that facilitates copyright infringement.
B. Service Abuse
- Attempt to circumvent storage limits, quota enforcement, or other technical restrictions.
- Access or attempt to access accounts or data belonging to other users.
- Interfere with or disrupt the Service or its infrastructure.
- Reverse engineer, decompile, or attempt to extract the source code of the Service.
C. Commercial Restrictions
- Resell, sublicense, or redistribute access to the Service without our written permission.
- Use the Service to provide archiving services to third parties.
9. Content Ownership & License
A. Your Content
You retain full ownership of all content archived through StreamVault, including VODs, chat logs, and associated metadata (“Your Content”). We do not claim any ownership rights to Your Content.
You represent and warrant that:
- You own or control all rights to Your Content;
- You have the right to grant the license in Section 9.B;
- Your Content does not infringe upon the intellectual property rights, privacy rights, or any other rights of any third party; and
- Your Content complies with all applicable laws and these Terms.
B. License to StreamVault
By using the Service, you grant us a limited, non-exclusive license to store, process, transmit, and display Your Content solely for the purpose of providing the Service to you. This license terminates when you delete Your Content or close your account.
C. No Monitoring
We do not actively monitor the content of your archives. However, we reserve the right to remove content that violates these Terms or applicable law.
10. Copyright and DMCA Policy
A. Respect for Intellectual Property
StreamVault respects the intellectual property rights of others and expects users to do the same. You are solely responsible for ensuring you have the necessary rights to archive and store any content through the Service.
B. Your Representations
By using the Service, you represent and warrant that:
- You are the owner of the Twitch channel linked to your account, or have explicit authorization from the channel owner to archive their content.
- You have all necessary rights, licenses, and permissions to archive the content captured through the Service.
- Your use of the Service does not infringe upon the intellectual property rights of any third party.
C. DMCA Designated Agent
In accordance with the Digital Millennium Copyright Act (17 U.S.C. § 512), we have designated an agent to receive notifications of claimed copyright infringement:

D. Filing a DMCA Notice
If you believe that content archived through StreamVault infringes your copyright, you may submit a written notification containing:
- A physical or electronic signature of the copyright owner or authorized agent.
- Identification of the copyrighted work(s) claimed to be infringed.
- Identification of the material claimed to be infringing, with information reasonably sufficient to locate it.
- Your contact information (address, telephone number, email).
- A statement that you have a good faith belief the use is not authorized by the copyright owner, its agent, or the law.
- A statement, under penalty of perjury, that the information in the notification is accurate and that you are authorized to act on behalf of the copyright owner.
E. Counter-Notification
If you believe your content was removed in error, you may submit a counter-notification containing:
- Your physical or electronic signature.
- Identification of the material removed and its prior location.
- A statement under penalty of perjury that you have a good faith belief the material was removed by mistake or misidentification.
- Your name, address, telephone number, and a statement consenting to jurisdiction of the federal court in your district (or Queensland, Australia if outside the US).
F. Repeat Infringer Policy
StreamVault maintains a policy to terminate, in appropriate circumstances, the accounts of users who are repeat infringers of copyright. We define a repeat infringer as any user who:
- Receives three (3) or more valid DMCA takedown notices within any twelve (12) month period; or
- Has content removed for copyright infringement on two (2) or more separate occasions; or
- Is determined by StreamVault, in its sole discretion, to be a repeat infringer.
Upon determination that a user is a repeat infringer, we will terminate their account and delete all associated content. This determination is final and not subject to appeal.
G. No Obligation to Monitor
We do not actively monitor archives for potentially infringing content. However, we reserve the right to remove any content and terminate any account at our sole discretion if we believe it infringes third-party rights.
11. Third-Party Services
A. Dependencies
The Service relies on third-party services including, but not limited to:
- Twitch (stream source and authentication)
- Backblaze B2 (cloud storage)
- Cloudflare (content delivery and security)
- Stripe (payment processing)
B. Third-Party Terms
Your use of these third-party services may be subject to their respective terms and policies. We are not responsible for the availability, performance, or policies of third-party services.
C. No Liability for Third-Party Outages
We are not liable for service interruptions, data loss, or other issues caused by third-party service outages or changes.
12. Limitation of Liability
A. Service Provided “As-Is”
THE SERVICE IS PROVIDED “AS IS” AND “AS AVAILABLE” WITHOUT WARRANTIES OF ANY KIND, EITHER EXPRESS OR IMPLIED, INCLUDING BUT NOT LIMITED TO WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, OR NON-INFRINGEMENT.
B. No Guarantee of Availability
We do not guarantee 100% uptime or uninterrupted access to the Service. We may perform maintenance, updates, or experience outages that temporarily affect availability.
C. Data Loss
While we take reasonable measures to protect your data, we are not liable for data loss due to hardware failure, software bugs, security breaches, third-party service failures, or other causes beyond our reasonable control.
D. Limitation of Damages
TO THE MAXIMUM EXTENT PERMITTED BY LAW, OUR TOTAL LIABILITY TO YOU FOR ANY CLAIMS ARISING FROM OR RELATED TO THE SERVICE SHALL NOT EXCEED THE TOTAL AMOUNT YOU PAID TO US IN THE 12 MONTHS PRECEDING THE CLAIM.
E. Exclusion of Consequential Damages
IN NO EVENT SHALL WE BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, OR PUNITIVE DAMAGES, INCLUDING LOSS OF PROFITS, DATA, OR GOODWILL.
13. Indemnification
You agree to indemnify, defend, and hold harmless StreamVault and its officers, directors, employees, and agents from any claims, damages, losses, liabilities, costs, or expenses (including reasonable legal fees) arising from:
- Your use of the Service.
- Your Content or any content you archive through the Service, including any claims that Your Content infringes the copyright, trademark, or other intellectual property rights of any third party.
- Your violation of these Terms.
- Your violation of any third-party rights, including intellectual property rights.
- Any claims by third parties related to your use of the Service.
- Any DMCA takedown notices, copyright claims, or intellectual property disputes related to content in your account.
You acknowledge that StreamVault provides a storage and archiving service only, and that you are solely responsible for ensuring you have all necessary rights and permissions for any content you archive through the Service.
14. Dispute Resolution
A. Informal Resolution
Before initiating any formal legal action, you agree to contact us at blake@streamvault.gg to attempt to resolve any dispute informally. We will work in good faith to resolve the matter within 30 days.
B. Governing Law
These Terms are governed by and construed in accordance with the laws of Australia, without regard to conflict of law principles.
C. Jurisdiction
If informal resolution is unsuccessful, any legal action arising from these Terms shall be brought exclusively in the courts of Queensland, Australia. You consent to the personal jurisdiction of these courts.
15. Changes to the Service
We reserve the right to modify, suspend, or discontinue any aspect of the Service at any time, with or without notice. We will make reasonable efforts to provide advance notice of material changes that significantly affect your use of the Service.
16. Termination
A. By You
You may terminate your account at any time by canceling your subscription and requesting account deletion.
B. By Us
We may suspend or terminate your account immediately if you:
- Violate these Terms.
- Engage in fraudulent or illegal activity.
- Fail to pay subscription fees.
- Abuse the Service or its infrastructure.
- Are determined to be a repeat copyright infringer under our DMCA Policy (Section 10.F).
- Receive DMCA takedown notices or copyright complaints related to your archived content.
- Archive content from channels you do not own or are not authorized to archive.
C. Effect of Termination
Upon termination, your right to access the Service ends immediately. We are not obligated to retain your data beyond the post-cancellation grace period described in Section 7.
17. Miscellaneous
A. Entire Agreement
These Terms, together with our Privacy Policy, constitute the entire agreement between you and StreamVault regarding the Service.
B. Severability
If any provision of these Terms is found to be unenforceable, the remaining provisions will continue in full force and effect.
C. No Waiver
Our failure to enforce any right or provision of these Terms does not constitute a waiver of that right or provision.
D. Assignment
You may not assign or transfer your rights under these Terms without our prior written consent. We may assign our rights and obligations without restriction.
E. Force Majeure
We are not liable for any failure or delay in performance due to circumstances beyond our reasonable control, including natural disasters, war, terrorism, labor disputes, or infrastructure failures.
